The presentation provided perspective from both a legal and investigative standpoint. The issues that she discussed included “What is the basis for a mortgagee’s claim? “What is the extent of that claim, and how is it evaluated?”, “How do the obligations of the mortgagee and named insured differ under the policy?”, “How does the foreclosure process affect rights of recovery?”, “What types of notice must a mortgagee provide to the carrier?”, “With what policy conditions must the mortgagee comply?” and “Under what circumstances is the mortgagee’s interest reduced or even eliminated outright?” |

Certuse, P.E.
of Industrial Services & Engineering, Inc (ISE) educated those in
attendance of ISE's Comprehensive Freeze-up Examination process to
identify the cause of freeze damage to residential homes. Mr.
Certuse also reviewed and discussed the importance of an Energy and
Fuel Usage Analysis during a freeze-up investigation and the
necessary first steps that should be taken by a field adjuster in
interviewing anyone who may be the first person on scene following
the discovery of the loss.

damages, legal issues and anticipated defenses & expert witnesses

Glenn Ricciardelli Jon Ducey Matson Driscoll Damico On May 20, 2019 Glenn Ricciardelli & Jon Ducey of
Matson, Driscoll & Damico presented a lecture entitled “Measuring
Economic Losses in these Economic Times, Looking Behind the Numbers
& Documenting a Paper Trail on Theft Losses”. This
presentation was based on a “perfect storm” of economic forces
(mortgages; credit cards; consumer/commercial borrowing; private
equity; hedge funds; credit default swaps, etc.) that had resulted
in an economic imbalance in virtually every corner of the world. |

“Leonard Morse-Fortier, PE, of Simpson Gumpertz & Heger Mr. Morse- Fortier discussed
the evolution of the Massachusetts Building Code with regard to
requirements for seismic upgrades to buildings where work is being
done. The lecture focused on the way the Code specifies
requirements along a sliding scale – one that is based upon the
“level” of work planned, along with the requirements themselves;
this was illustrated in a real-life, insurance claim examples.
The discussion also touched upon how the degree of repair work may
trigger requirements for improvements in accessibility.” |
